Australia introduced new Student visa application rules on 2 October 2026. The changes affect whether people already in Australia can apply for a Student visa, whether existing students can apply for another one onshore, and when family members can be included. Indian students planning to study, extend their course or move between courses should check the rules before making travel or financial commitments.

The changes are not an India-only ban on studying in Australia. They apply across affected visa groups, with specific exemptions. The Australian Government says the reforms do not affect current Student visas, and applicants who cannot apply from inside Australia may still be able to apply offshore if they meet the requirements.

What changed from 2 October 2026?

Under the updated rules, most temporary visa holders can no longer apply for a Student visa (subclass 500) while they are in Australia. Student visa holders generally cannot apply for another Student visa from within Australia unless an exemption applies. If an applicant must apply offshore, they must also be outside Australia when the new Student visa is granted.

The Department of Home Affairs warns that an application lodged in Australia when the applicant is required to apply offshore may be invalid. Students should confirm their own visa status and eligibility before lodging an application.

Are there exemptions?

Yes. The rules list exemptions for certain categories, including students sponsored by Australia’s Department of Foreign Affairs and Trade or Department of Defence; applicants for doctoral, primary or secondary school studies; students affected by an education-provider default; students who need up to 12 additional months to complete a course with the same provider; and students progressing to a higher-level course after completing the main course covered by their current visa.

These exemptions are specific. Do not assume that changing courses, holding a valid visa or being an international student automatically makes an applicant eligible to apply onshore.

Can Indian students include family members?

The new rules also restrict including family members in a first or further Student visa application unless an exemption applies. Exemptions include doctoral students, nationals of Pacific countries and ASEAN countries, recipients of fully funded foreign-government scholarships, and students sponsored by Australia’s Department of Foreign Affairs and Trade or Department of Defence.

Indian nationality alone is not one of the listed nationality-based exemptions. Eligible students should check whether another exemption applies to their circumstances. The government also says family members cannot be added after a Student visa has been granted.

There are transitional arrangements for some existing families: the same family members may be included in a further application if they were already included in the visa or application before 2 October and the student is eligible to apply for a further Student visa in Australia. Applications lodged before 2 October continue to be assessed under the rules that applied when they were lodged.

What should Indian students do before applying?

  1. Read the Australian Department of Home Affairs’ official explanation of the new rules.
  2. Check whether you can apply while in Australia or must lodge from outside the country.
  3. Confirm whether any exemption applies to your course, sponsorship or family circumstances.
  4. Check the conditions and expiry date of your current visa before making travel or enrolment decisions.
  5. Use a registered migration agent or qualified adviser if your case involves a complex visa history or family arrangements.

Do the changes affect students who already hold a visa?

The government says the new rules do not affect current Student visas. However, they may matter if a student later applies for another Student visa, seeks to include family members, or plans to lodge an application while in Australia. Further reforms for students changing education providers are still being developed, so those details should not be treated as final until formally announced.

Where can students check the latest requirements?

The most reliable starting point is the Australian Department of Home Affairs’ Student visa rules page. The government’s Study Australia explainer summarises the main changes. A report published by The Guardian on 23 October described uncertainty among international students following the changes.

This guide summarises published rules and is not individual migration advice. Visa requirements can depend on a person’s circumstances; verify the current official guidance before acting.
